  4. Securely encased refers to some type of container that would prevent open access to the weapon. A weapon is not readily accessible if: (1)You have to open a container or any kind of encasing before you can use the weapon; or (2)The firearm is completely out of reach from your vicinity and it would be impossible to immediately use.
  5. If you are engaging in self defense or are standing your ground.To stand your ground refers to the legal use of a firearm in a public area for self-defense, even if it is possible for you to avoid violence by leaving the area.

Step 3

In Florida, you can apply with the Department of Agriculture and Consumer Servicesfor your concealed weapons permit. Processing usually takes 50-55 days to get your permit. Not everyone qualifies and you can find a list of disqualifying reasons here.

What are the benefits of having a concealed weapons permit?

– Any polling place;

– Any meeting of the governing body of a county, public school district, municipality, or special district;

– Any meeting of the Legislature or a committee;

– Any school, college, or professional athletic event not related to firearms;

The police identified Brunson as the perpetrator and as Brunson got out of his car and began walking to his apartment, he was stopped, handcuffed, and arrested. After, the police asked him where the gun was located and Brunson said it was under the front seat. The following would suggest Brunson was guilty of carrying a concealed weapon:

  • The weapon was not in an enclosed case.
  • The weapon was under his seat, which allows for easy accessibility.
  • He did not have a concealed weapons permit.

However, because the policeman saw Brunson exit out of the car and begin walking to the apartment, the gun was not on his person. This means it was not readily available to him at the time that the policeman stopped him. This being the case, the state didnot have enough evidence to prove that he was carrying a concealed weapon that it was accessible to him at the time of his encounter with the police!
